Encumbrance Certificate - how to get EC?

The Encumbrance Certificate is a mandatory document used as evidence of ownership for property transactions. before buying a house, flat or plot it is important to verify that property doesn't have any legal dues. Encumbrance Certificate ensures that there is complete ownership of the property without any monetary or legal liabilities. EC for the property can be obtained from Sub-Registrar's office. where the particular property has been registered. EC is very much needed when you apply for a home loan. generally, Encumbrance certificate contains all kinds of transactions registered related to a particular property for a certain period of time as required. mostly government authorities and banks will demand 15 years of Encumbrance. but if you needed. you can ask for up to 30 years of Encumbrance certificate to be checked. still, you are not satisfied and have doubts then you can get a Possession Certificate of the ownership of a particular land which is available in the village offices.

Steps to obtain EC:



  • First download form 22. affix it with RS 2 non-judicial stamp address to the Tahsildar along with an attested copy of your residential address. please mention the purpose for the EC is required
  • Then you need to provide the details of your ownership such as the correct survey number and place where the property is situated. and it is important to mention full details of the property clearly in the application
  • The requisite fee needs to be paid. it needs to be paid based on the period of Encumbrance. the Encumbrance year will commence every April 1st of a calendar and closes March 31st of next calendar year. mostly EC is provided in regional language. in order to obtain in English, you need to pay an additional fee.
  • The application should be submitted to jurisdiction sub registrar's office where the property is under registered
Time taken to obtain EC may vary from 15 to 30 working days. although there are certain documents that are exempt from being registered at the sub registrar's office. and this will not appear in EC. so it better buyer obtains both Encumbrance certificate and possession certificate as a proof for complete ownership of the property
